Terms of Service

1. Description of Service

KidsNow is a platform that helps parents and carers discover, save, and book kids' activities across Australia. The App provides activity recommendations, location-based search, booking functionality, and related features. We may modify, suspend, or discontinue any part of the App at any time without notice.

2. Eligibility

You must be at least 18 years old to create an account and make bookings. By using the App, you represent that you are a parent or legal guardian authorised to make decisions on behalf of the children whose information you provide.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You agree to notify us immediately of any unauthorised use of your account.

4. Bookings and Payments

• Bookings are made through activity providers and payment is processed securely via Stripe.
• All prices are in Australian Dollars (AUD) and include applicable taxes where indicated.
• Cancellation and refund policies vary by activity and are displayed at the time of booking.
• We are not liable for the quality, safety, or delivery of activities provided by third parties.
• Free activities may require registration but do not involve payment through the App.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Provide false or misleading information about your children or booking details.
• Attempt to access, tamper with, or disrupt the App's systems or data.
• Scrape, copy, or redistribute activity listings without permission.
• Use the App to send spam, harass others, or transmit harmful content.

6. Intellectual Property

The App, including its design, content, logos, and software, is owned by KidsNow and protected by Australian and international intellectual property laws. Activity listings and images may be provided by third parties and remain their property. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. User Content

You retain ownership of any information you submit (e.g. child profiles, saved activities). By submitting content, you grant us a licence to use it solely to provide and improve the App's services. You are responsible for ensuring you have the right to share any information you provide.

8. Third-Party Services

The App links to third-party websites, activity providers, and payment services (Stripe). We are not responsible for the practices or content of these third parties. Your interactions with third parties are solely between you and them.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that activity information is accurate, complete, or up to date. You should verify details directly with activity providers before attending. We do not warrant that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, KidsNow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim shall not exceed the amount you paid through the App in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold KidsNow harmless from any claims, damages, or expenses arising from your misuse of the App, violation of these Terms, or infringement of third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause. You may delete your account at any time. Upon termination, all licences granted to you will cease. Sections that by their nature should survive termination shall remain in effect.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, and you submit to the exclusive jurisdiction of those courts.

14. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
